The VW emissions scandal (so-called "Dieselgate") began on September 18, 2015, when the US Environmental Protection Agency (hereinafter "EPA") issued a "Notice of Violation of Clean Air Act ".

The EPA held that the VW Group intentionally programmed its EA189 diesel engine to detect when a vehicle was in test mode on the dyno. In this mode, certain emission control mechanisms were triggered that were not active during normal operation. This program (known as a "defeat device") caused the manipulated engines to comply with the emission limits for nitrogen oxide (NOx) during test mode, but to exceed them by up to 40 times during normal operation.

The VW Group applied this manipulated EA189 diesel engine worldwide in a total of approximately 11 million vehicles of its group brands VW, Audi, Seat, Skoda and Porsche. In Switzerland, around 180,000 manipulated vehicles were put into circulation, and in Austria as many as 388,000.

Over time, there was increasing evidence that not only the EA189 diesel engine, but also other VW engines were manipulated, such as the newer 288 engine and the 3l V6 / 4.2l V8 engines (EA897), which were used in premium vehicles from VW, Audi and Porsche. In addition, the scandal has spread to other vehicle manufacturers such as Daimler, Opel, BMW and FIAT.

Dr. Alexander Amann LL.M. (UCLA) has developed a lawsuit together with the Swiss Foundation  for Consumer Protection in order to be able to enforce claims by affected vehicle owners in Switzerland as well. At the end of 2017, a first group action for damages for injured vehicle owners and lessees was filed with the Commercial Court in Zurich. In Austria we are helping aggrieved vehicle owners together with the non-profit association COBIN Claims to assert their justified claims for damages against the seemingly invincible VW Group.
