Criminal proceedings, insolvencies, and investor protection
1. Sun Contracting and Green Finance Group are under scrutiny by financial market regulators and law enforcement agencies

Bonds, debentures, subordinated loans, and possibly other financial products from various group companies of Liechtenstein-based Sun Contracting AG were sold to numerous investors in Switzerland, Austria, and Germany with sales pitches about the potential of photovoltaic technology, high-yield investments in solar energy, and sustainable “green investments.” These financial products were also brokered in particular by companies belonging to Liechtenstein-based Green Finance Group AG.

Green Finance Group itself appears to be pursuing a similar business and financing model based on the issuance of bonds. For several years, it has been issuing bonds through its Liechtenstein subsidiary Green Finance Capital AG to finance the business activities of Green Finance Group.

From an investor's perspective, this is a high-risk investment model with significant problems in terms of default risk, lack of transparency, conflicts of interest, and a conspicuous distribution structure.

Accordingly, the Austrian Financial Market Authority (FMA) issued a penalty notice against Green Finance Group AG and Green Finance Capital AG for misleading advertising. The Hungarian Financial Market Authority (MNB) fined Sun Contracting AG and Green Finance Broker AG for the unauthorized distribution of bonds. The Austrian Public Prosecutor's Office for Economic Affairs and Corruption is investigating several individuals and associations in connection with Sun Contracting and Green Finance Group on suspicion of fraud and other economic crimes.

2. Insolvency proceedings

On October 31, 2025, five Austrian subsidiaries of Sun Contracting AG filed for insolvency at the Linz Regional Court. On November 5, 2025, insolvency proceedings were also opened against Sun Contracting AG and Sun Invest AG, both based in Balzers, Liechtenstein, at the Princely Regional Court. Insolvent companies in Liechtenstein: Sun Contracting AG and Sun Invest AG, Balzers. Insolvent companies in Austria (Linz): Sun Contracting Austria GmbH, Sun Contracting Engineering GmbH, Sun Contracting Projekt GmbH, Sun Contracting Solutions GmbH, Sun Contracting Norica Plus GmbH. The total liabilities of the five Austrian companies of the Sun Contracting Group amount to approximately EUR 47.34 million. Over 1,500 investors are affected by the insolvency.
